Terms of service

These MVP terms are a draft and need review by counsel. They summarise how the service works today.

1. The service

realfly turns listing photos you upload into AI-generated flythrough videos that you can deliver to your own clients under your own brand. You (the reseller) are our customer; your clients are not party to these terms.

2. Your responsibilities

You are responsible for reviewing and approving every video before it is delivered to your client, and for making sure its use complies with MLS, listing-portal, advertising and disclosure rules in your market.

AI-generated motion can introduce artifacts or inaccuracies. realfly runs automated checks, but they do not catch everything. Nothing is delivered to your client until you approve it, and your approval confirms you have reviewed the video and accept it as an accurate representation of the property.

You confirm that you have the rights to every photo you upload (or permission from the owner), and that you will not use the service to misrepresent a property.

3. AI disclosure

An AI-disclosure label is on every video by default. You can switch it off for a project; if you do, you accept responsibility for meeting the disclosure rules in your market, and the change is recorded. If you switch it off, you accept responsibility for complying with the AI and advertising disclosure rules in your market (including California AB 723 and Wisconsin Act 69 where they apply). An unbranded, MLS-safe version and an original-photos page are provided to support disclosure rules; you remain responsible for using them correctly in your market.

4. Plans and credits

  • 1 credit = one ~30 second video. A ~60 second video costs 2 credits. Credits are only used when a video is delivered.
  • Unused credits roll over month to month while your subscription is active, for up to 12 months from the date they were issued. The oldest credits are used first.
  • Annual billing: pay for 10 months, get 12 (2 months free). The whole year's credits are added when the annual payment goes through.
  • Top-up credits cost US$15 / A$23 each; choose how many at checkout. They need an active plan and follow the same 12-month rollover and cancellation rules.
  • Each video includes up to 6 free shot re-runs before you approve it.
  • US$1 (A$2) for a 7-day trial of Pro with 1 credit (one ~30 second video, no watermark). On day 7 it becomes Pro at US$149/month (A$229 in Australia) unless you cancel or switch plans first. We email you 3 days before. One trial per account and per card. Your trial credit is yours to keep if you cancel or switch.

5. Cancellation, no pause

  • If you cancel, your plan stays active until the end of the paid period. Remaining plan and top-up credits are forfeited when the subscription ends.
  • Subscriptions cannot be paused. You can cancel at any time and subscribe again later.
  • Credits have no cash value, are not refundable, and expire 12 months after issue. Subscription fees are not refundable except where the law requires (for example, under the Australian Consumer Law).

6. Failed renders and re-runs

If a video still can't pass our accuracy checks after its automatic re-generations and re-runs, its credit is returned automatically. Every shot either passes our accuracy check or is replaced by a no-invention photo move; if we can't produce that, the video fails and you're not charged. Otherwise all sales are final. Before approval you may re-run individual shots up to 6 times per video at no extra cost. Dissatisfaction with an approved, delivered video is not grounds for a credit refund.

7. Your content and white-label output

You keep ownership of your photos and brand assets. You grant realfly a licence to process them to provide the service. Delivered videos may be used by you and your clients for marketing the listed property.

8. Disclaimer and liability

The service is provided as is. To the extent permitted by law, realfly is not liable for indirect or consequential loss, and our total liability is limited to the fees you paid in the three months before the claim. [Counsel to confirm.]
